Contrary to a number of posts I've read, my goal isn't to make money here. I'm in no way asking for a full refund, simply the depreciation of value between when I (and others) purchased the card and the value of the card on the day a driver is released for Vista that fully enables all functionality on the card without major issues and is stable enough that 4/5 posts aren't about BSODs or other erratic fun-loving behavior.
Anyone who is interested in pursuing this from a legal perspective should understand the following points:
* Attorneys are the only ones that make money from class action suits, not plaintiffs, particularly in the amounts we're talking about here.
* If it went to court and if it won, you'd likely only see a fraction of the value you've lost. The damage done isn't through payouts, it's through the defendant paying the legal fees of the plaintiff.
* This site would be down instantly if NVidia would so much as:
o Respond Publicly and Apologize. Thus far communication has been relegated to the unfortunate admins on the forums who've been stuck with the miserable task of trying to spin this in any remotely good way possible. My favorite suggestion of course is that you don't need to upgrade to Vista since it doesn't offer anything new - something I, and many others quite obviously and vehemently disagree with.
o Provide an Anticipated Release Date for Stable Drivers, i.e. non-beta. We all understand the drivers undergo constant revisions and as such are never final, but we've paid a lot of money to be in a beta test for their product. Personally, I would've waited until such a date to purchase the card (and saved money doing so...) or gone with another vendor /cough /cough.
o Offer Some Token Gesture. I don't really care what, but as my interview on TGDaily stated - anything - a stupid t-shirt, game or rebate certificate (not asking for a full rebate...but some amount) would really go a long way IMO.
o While I know this one is pretty much next to impossible for oh so many reasons - Print Boxes Without the "Designed for Vista" / "Ready for Vista" Statement. Again, this is probably near next to impossible but it's wishful thinking. Then again, if the person who's pea-brained idea this was to market it and not be close to ready happened to leave the company that'd totally make my day
Obviously I'm not out to make money here. There's no way to do so and this is quite obviously costing me money to run yet where's the PayPal link or advertisements? Ahh...there aren't any, so any assertion that I'm out to make a buck is outright false
